
XC3 Terms and Conditions. These Terms and Conditions are accepted in addition to any contract made between Hybrid Solutions and Site Users, although they may be modified in such contracts.
1. Terminology. The terms "employer" or "company" refer to any organisation given access to the XC3 database and with the aim of searching for personnel for employment, whether for the organisation itself or on behalf of others. The term "candidate" or "job seeker" refers to those who are using or interested in using the site to make their career and related information available to employers. The term "profile" refers to a combination of a candidate's Curriculum Vitae and information requested by the XC3 system, but excluding name, email address and telephone number.
2. Information Security. In accepting these terms and conditions, employers accept that information systems are never absolutely secure and accept the following Hybrid Solutions information security policies as adequate in ensuring information security. Employers may not therefore hold Hybrid Solutions liable for any damages resulting from any compromise of data security:
- Hybrid Solutions do not store any employer information in the XC3 website database and a company entry in the XC3 database consists of a login name, password and an optional contact email address if added to an employer's account by that employer in the employer options page.
- Employers may wish to use the XC3 site record keeping system to record their emails and notes, and may wish to save an email address so that the software can copy to them any emails sent by them. This is done entirely at a company's own risk and Hybrid Solutions may not be held responsible for any disclosure of this information through unauthorised access to the system or any other reason. The record data is not encrypted at any stage.
- Hybrid Solutions operate a web based email system which is run on the same server as the XC3 website, therefore any compromise of the XC3 website database or server may also lead to a compromise of the email system. Employers accept that if concerned about security to this extent, they should not send any emails to (any address)@xc3.co.uk which contain an employer login name or any other information which may allow a connection to be made between an employer's XC3 login name and the employer.
- Hybrid Solutions receives a copy of any emails sent by employers to candidates through the site system. These emails are not stored on the XC3 website server.
- In summary the high level of security offered to employers by Hybrid Solutions is as a result of the Hybrid Solutions policy of minimal information storage and separation of site user information and 'real' information, rather than encryption technologies.
3. Services Provided.
- Hybrid Solutions does not guarantee the consistency of service provided by the website, although no charge will be made for any complete calendar days in which the website is unavailable for use for whatever reason. Hybrid Solutions may not be held liable for any damages resulting from any inability of an employer to contact candidates as a result of site failure or lack of availability.
- Hybrid Solutions do not guarantee the integrity of record-of-use data held on the system as part of the site organiser. A complete back up of the site is made every 24 hours, but in accepting these terms and conditions, employers accept that occasional data loss is an inherent risk of electronic storage means and that Hybrid Solutions may not be held liable for any loss resulting from data loss.
- Hybrid Solutions does not guarantee that the database structure will remain unchanged. The structure is likely to change as a result of site evolution in response to employer information requirements.
4. Damages Caused. Hybrid Solutions may not be held responsible for any damages resulting site use, be that from failure of the site software system, external factors such as unauthorised access, passage of software viruses or for any other reason.
5. Limits of Responsibility. By accepting these terms and conditions employers accept that Hybrid Solutions is not involved in the relationship between themselves and candidates after initial contact has been made with a candidate through the site email system. Hybrid Solutions may not therefore be held responsible for any subsequent damage caused to or by a candidate or employer as a result of the involvement of the Hybrid Solutions staff or website in the recruitment process. While Hybrid Solutions do screen all candidates before accepting their profiles for publication on the XC3 website, employers accept that the website is a direct information path between candidates and themselves and that it is their responsibility to confirm any candidate information held on the system at interview or by any other means. Hybrid Solutions may not be held liable for any damages resulting from inaccuracies in candidate data. Moreover, candidates have constant access to their own profile data, and employers are warned that candidates may change their profiles after the initial XC3 screening process.
6. Computer Requirements. The XC3 website is designed for use with Microsoft Internet Explorer version 5.5 and above. Additionally the site stores small files called cookies on users' computers and runs javascript programs in users' browser software for some site functions. This is very common and allows information to be presented more clearly, and users to log in and be recognised as they move though the site. Employers accept that the site may not function correctly if using any other browser version or if javascript or cookies are disabled in the browser security settings. Hybrid Solutions may not be held responsible for any problems or disadvantage arising from the use of IT equipment that does not conform to these requirements.
7. User Responsibilities. In agreeing to these conditions, employers undertake the following responsibilities:
- To maintain their account security to the best of their ability through standard good practice such as regular changes of password and the use of complex passwords which are neither english words nor names and which contain a mix of letters,characters and numbers.
- To always log out from the site after use by clicking on "logout" in the title bar.
- To report any security related problems to Hybrid Solutions at admin@xc3.co.uk.
- To treat all contact made though the site by candidates as strictly confidential and not for discussion or disclosure to anyone other than the candidate concerned or Hybrid Solutions staff as detailed below.
- To disclose to XC3 staff where requested the following information about contact with candidates initiated through the XC3 database and email system (note: candidates also agree to this clause when accepting their terms and conditions):
- Dates and number of any interviews, whether by telephone or in person.
- Date and length of any contract signed.
